1. Introduction Welcome to Nico Gallery ("we", "us", "our"). These Terms & Conditions govern your use of our website and the purchase of our creative, media, and design services.
Nico Gallery is the trading name of Mykola Tymoshenko, operating from Scotland, United Kingdom. By accessing our website, placing an order, or communicating with us, you agree to be bound by these Terms.

2. Our Services & Project Execution Nico Gallery provides a comprehensive range of visual communication and design services, including photography, videography, audio recording, photo/video/audio editing, sound design, web design, and corporate rebranding.

• Network of Professionals: While Nico Gallery operates as an independent startup, we reserve the right to engage trusted freelance professionals or contractors for specific tasks if a project requires additional expertise or resources. Regardless of who executes the work, Nico Gallery remains your sole point of contact and is fully responsible for delivering the final product to our agreed standard.

3. Orders, Quotes, and Payments

• Placing Orders: Orders and inquiries can be submitted via our website or direct email. A project is only considered active once we have agreed on the scope of work in writing and received the required deposit.

• Payments: We accept payments via bank transfer or secure online payment links (when applicable). You agree to provide accurate billing information.

• Refunds & Cancellations: Due to the custom nature of our creative and design services, deposits and fees for work already commenced or completed are strictly non-refundable, unless otherwise agreed in writing.

4. Intellectual Property & Copyright

• Ownership of Assets: All raw footage, unedited photos, project files, and initial design concepts remain the exclusive intellectual property of Nico Gallery until full and final payment is received.

• Client License: Upon full payment, you are granted the agreed license or ownership rights to use the final delivered media for your intended purposes.

• Portfolio Rights: We are proud of the work we create. Nico Gallery reserves the right to use any completed project (including brand designs, photos, and videos) in our portfolio, website, and social media for promotional purposes, unless a Non-Disclosure Agreement (NDA) is signed prior to the commencement of the project.

5. Client Responsibilities & Revisions To ensure your project is delivered on time, we require your timely feedback and the provision of any necessary materials (e.g., logos, text, brand guidelines).

• Revisions: Each project quote includes a specific number of revision rounds. Any additional revisions requested beyond the agreed scope will be billed at our standard hourly or project rate.

6. Limitation of Liability To the maximum extent permitted by law, Nico Gallery shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of our website or services. Our design and media services are provided to the best of our professional ability, but we make no guarantees regarding specific business outcomes resulting from our rebranding or content.

7. Governing Law These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.
